B4IO

望著鐘, 兩點,三點,一直去到六點,還是睡不著.奇怪,真的有點緊張.

最後,只睡了一個鐘就去考試,一路上,不停叫自己要精神點, 但感覺到,讀了的notes,背了的equations,CY堂上的笑話,都逐一的流失.腦袋空白了.

這兩天,對聲音很敏感,昨晚被本應習以為常的車聲吵得心煩.今日被鄰座同學用塗改帶時的 "格格格"聲弄得一時不能集中.

憑凌亂的記憶捱過了兩小時的考試.

不快樂是:什麼都沒有發生。

他們活在兩難中。有時候想想,人生苦短,青春易逝,不如及時行樂,嬉戲度日,但午夜夢迴,又怕浪費時間,磋跎歲月,到頭來一時無成,晚景堪憐;一邊覺得自己玩得不夠徹底,為實務糾纏未能放縱盡歡,一邊怨自己未能盡力工作,經常貪逸樂而沒榨乾自己投入在事業上;同時盡做盡玩,有這樣精力的有幾人?要透支精力,就要做運動打坐,結果每天花時間去搞好身體使自己能減少休息時間換取多點時間去做去玩;還要記住不能暴飲暴食,否則前功盡棄;這時候有人會說,我們中國人講中庸之道,但大夥的問題正因為太中庸,想玩的東西太多沒精力去玩,想做的事情沒太多時間去做。霧數煞。

Paper....

完成了Politics的term paper, 寫得不好. 知道自己還不能論及最深入的層面. 比較滿意的是分析inductive way of deriving entitlement thoery, arguments on patterned theory, 和
absoluteness of private property right的部分.

Justice一個字, 在political philosophy的範疇已"玩"了數十年. 什麼是社會公義, 報紙說了很多, 你認為呢? 不要人云亦云, 要嘗試建立自己的價值觀.

Robert Nozick’s entitlement theory of justice

1. Robert Nozick’s entitlement theory
Justice, for Nozick, is not about arranging social-economic inequalities and to offer fair equality of opportunity to the members of a society. Justice is about respecting people’s right to self-ownership and their right to hold property. People should be free to determine how to use what is theirs.

In Anarchy, State, and Utopia Nozick defends the minimal state. The state should be ‘limited to the narrow functions of protection against force, theft, fraud, enforcement of contracts and so on’ (Nozick, 1874: ix). Any state try to redistribute resource is infringing people’s legitimate holdings of private property. Its role should be limited to protecting people from such intrusions by others. States extends its functions beyond the narrow range of functions defined as above is regarded as unjust.

In Nozick’s view, people are free to do what they like with what is theirs. And there are three kinds of thing that might be theirs: (a) their selves, e.g. your body and natural born ability; (b) the natural world, e.g. land and natural resources; (c) the things people make by applying themselves to the natural world, e.g. tables, chairs, etc. He identifies three ways in which people can acquire a legitimate property holding under his entitlement theory. There are three sets of rules of justice, defining:
1. how things not previously possessed by anyone may be acquired;
2. how possession may be transferred from one person to another; and
3. what must be done to rectify injustices arising from violations of (1) and (2).

A distribution is just if it has arisen in accordance with these three sets of rules.

Initial acquisition refers to the case of original acquisition of holding, whereby somebody comes to make their own property which is previously un-owned. Imagine people settling for the first time an uninhabited continent. In Nozick’s view the land and natural resources of that continent do not belong to anybody, and may legitimately be acquired by individuals on a first come first served basis, as long as nobody is made worse off by their dong so.

Transfer of holding refers to the process which a person may acquire a holding from another who holds it. Once somebody owns anything, she can do what she likes with it, of course including giving it to someone she likes, on whatever terms may be voluntarily agreed between them. This, for Nozick, is what happens in the market. In this free market, state should protect people’s property right and ensure free transaction is not being interference.

Nozick knows that not all situations are generated according to the first two principles: principle of acquisition and principle of transfer of holding. Unjust and involuntary transfers of holding did happen in the history of the world. Those equipped with better weapons have forced those weaker than themselves to give up what was rightfully theirs. It is the principle of rectification, which holds that unjust transfers may be rectified by compensating transfers that themselves create entitlements.

2. Objection to redistributive taxation
According to the theory of entitlement by Nozick, the role of government should be keep minimal which means that taxes could only be levied on the ground of protecting private property rights. Any kind of redistributive taxation, like public education and health-care system are rejected and regarded as unjust by Nozick. Nozick believes that ‘taxation of earnings from labor is on a moral par with forced labor’.

Vast and structural inequalities could arise in such a society. However, Nozick would say these inequalities are just. People own themselves, however, due to the differences in natural ability endowment, they worth different amounts in the free market. People who born with weakness and illness are in disadvantage, Nozick thinks this is bad luck which might be unfair, but not unjust. As long as people’s property rights are respected and free trade is not disturbed by other forces, whatever distribution results, it is just. Redistribution of resources should not be forced through the mean of taxation, it should be voluntarily given out by people to those less fortunate. Whether somebody has a justice claim to something depends solely on the chain of events that led to them having it. Inequality could be just, equality could be just. There is no justice claim involved in enforcing redistributive taxation.
